SUBJECT: Jurisdictional Information on Tile Types and Sizes

  1. Problem: There are few jurisdictional disputes involving ceramic tile except for thick Tile Type Stone or Pavers. That one item needs to be clarified because of increasing inquiries about them.

  2. Solution: Jurisdictional disputes on thick pavers can be avoided by specifying units 1 1/4" thick and less in the Ceramic Tile Section, CSI Division 9, of the specification. Units thicker than 1 1/4" should go in the Masonry Section, CSI Division 4.

Reason:

  1. If you read the sections from the working agreement, (below), you will find no restriction as to the thickness or size of tile units.

    Section 1.  This Agreement pertains to the setting, slabbing or installing of all classes of TILE, whether for interior or exterior purposes, in any public or private building anywhere within the jurisdiction of Tile Layers Local No. 18.

    Section 2.   Tile Layers Work is defined as:

    1. The laying, cutting or setting of all tile where used for floors, wafls, ceilings, walks, promenade roofs, exterior veneers, stair treads, stair risers, facings, hearths, fireplaces and decorative inserts, together with any marble plinths, thresholds or window stools used in connection with any tile work; also to prepare and set all concrete, cement, brickwork or other foundations or material that may be required to properlv set and complete such work.

    2. The application of a coat or coats of morta, prepared to proper tolerance to recieve tile on floors, walls and ceilings regardless of whether the mortar coat is wet or dry at the time the tile is applied to it.

    3. The setting of all tile bonded with mortar, where the bed is floated, screeded, slabbed or buttered and where joints are not filled in the same operation.

    4. The setting of all tile by the adhesion method with organic and/or inorganic thin-bed bonding materials where such bonding material is applied to the backing surface and/or the back of tile units or sheets of tile.

    5. The setting of tile as herein provided shall include the installation of accessories and the insertion of decorative tile inserts in other materials.

    6. The setting, sealing and installation of prefabricated tile systems and/or panels.

    Section 3."TILE" is herein defined as the following products:

    1. All burned clay products, as used in the Tile Industry, either glazed or unglazed.

    2. All composition materials, marble tiles, glass, mosaics and all substitute materials for tile-like units.

    3. All mixtures in tile-like form of cement, metals, plastics and other materials, that are made for and intended for use as a finished floor surface, stair treads, promenade roofs, walks, walls, ceilings, swimming pools and A placeswhere tile is used to form a finished interior or exterior surface for practical use, sanitary finish or decorative purposes.

    4. It is hereby agreed that the cutting of all material by machinery or tools on the job site shall be the work of the Tile Layers exclusively.

  2. However, both the Tile Layers and Masons belong to the same International Union and the Union Constitution and Bylaws divide the Tile Type Paver work at the 1 1/4" thickness even though the working agreement does not.

Tile Contractors have contracted for and installed Tile Type Paver units thicker than 1 1/4" but it often takes winning a jurisdictional ruling, handed down by the National Labor Relations Board (NLRB) after a 10(k) case. jurisdictional decisions handled in the Tilelaying and Masonry International Union will be decided by the 1 1/4" thickness. If jurisdictional problems are to be prevented, specify 1 1/4" thick and less units in Ceramic Tile Division 9 and over 1 1/4" units in Masonry Division 4.
